Tim Boyce case: Former Delaware County emergency services director faces new charges

MEDIA, Pa. (WPVI) — New charges are being filed against former Delaware County Emergency Services Director Tim Boyce after a second person came forward with allegations.

A second criminal complaint was filed on Tuesday.

According to the affidavit, the alleged victim worked for Boyce in emergency management and first spoke to county investigators in April.

The woman claims Boyce showed explicit photos of herself, lifted her dress to reveal her underwear, and made numerous sexual comments in 2018.

In one case in January of this year, the affidavit states that Boyce came into the defendant’s office, “leaned over to her, put his arms around her and placed his hands on her buttocks.”

In May, the state’s attorney general filed the first charges of indecent assault and harassment against Boyce.

In this case, Boyce is accused of groping his executive assistant earlier this year.

All of the alleged incidents occurred during Boyce’s tenure as district director, a position from which he was fired in May.

“We’re going to, as they say, continue to take the hits,” said Boyce’s attorney, Andrew Edelberg.

Boyce appeared in court Wednesday morning for a special hearing on the first count.

His lawyer told Action News that they were completely blindsided by the latest allegations.

“Although the Office of the Assistant Attorney General had several months to investigate the case and notify my office of any pending investigation, the Assistant Attorney General called me yesterday morning at 9 a.m. and informed me of the second case,” Edelberg said.

On Wednesday, Boyce’s attorney asked in court that the judge issue subpoenas to produce evidence in the original case before the scheduled preliminary hearing, but that request was denied.

“Mr. Boyce looks forward to appearing in court to rebut and contest the charges. He will fight vigorously starting today,” Edelberg said.

In a statement, a Delaware County spokesperson told Action News that they are cooperating with the investigation:

“Delaware County terminated Director of Emergency Services Tim Boyce on May 10, 2024, based on information from multiple sources regarding unacceptable workplace conduct, including allegations of gross misconduct.

Delaware County is cooperating with the ongoing investigation, which includes both the most recent charges brought against Mr. Boyce as well as the prior allegations and charges.

The County Council and County leadership are committed to protecting the County workforce and part of that commitment is ensuring a fair and thorough investigation of any complaints or allegations raised by our County team. The safety and security of every County employee is one of the most important priorities of the County Council and County leadership. Harassment, discrimination and retaliation will not be tolerated in the County and the Council is committed to ensuring the work environment is safe for all County employees.”

Boyce remains free on bail.

He is due back in court on September 11, 2024.
