LINCOLN, Nebraska (KLKN) – A Lincoln man has been brought before a district court on charges of molesting a baby.

On Monday, a judge ruled that there was sufficient suspicion in this case to bring 35-year-old Robert Herbert to trial.

In March, a two-month-old baby was brought to Children’s Hospital in Omaha.

According to police, the girl choked and turned blue after Herbert forced water up her nose to clear the congestion.

Doctors reported that the baby also had a skull fracture, seven broken ribs and several bruises.

According to court documents, the skull fracture was caused by blunt force trauma.

An affidavit states that when Herbert tried to help the baby have a bowel movement, he squeezed her arms and legs so tightly “that his arms were shaking.”

He also hit the girl on the head with a car seat “out of frustration,” court documents say.

Herbert is accused of intentional child abuse causing personal injury.

His arraignment in Lancaster County District Court is scheduled for September 25.
