Father of murdered five-year-old attacks boy’s killer during sentencing

SAN ANTONIO — The biological father of a 5-year-old boy was escorted out of a Bexar County courtroom Wednesday after throwing a tantrum during a sentencing hearing.

The incident occurred in the 226th District Court during a hearing in the case of Daniel Garcia, who was found guilty in May of assault on a child for causing the death of five-year-old Domenic Aguilar-Acevedo.

The boy’s father, David Engwiller, who had been staring at Garcia throughout the hearing, suddenly stood up from his chair and attacked Garcia.

Engwiller had to be detained by bailiffs and escorted out of the courtroom.

Garcia faces a prison sentence of between five and 99 years or life imprisonment.

The verdict is pronounced by Judge Velia Meza.

Domenic is said to have died in a San Antonio hotel in 2021 and was subsequently abandoned by Garcia and the boy’s mother, Nickolle Aguilar, in a ravine on a mountainside in Colorado.

Last week, Aguilar was sentenced to 15 years in prison for her role in the crime. She received a deal because she testified against Garcia during the trial.

Aguilar testified at Garcia’s hearing, which KSAT is broadcasting live.
